OpenAI shifts away from broad NDAs for data center projects

OpenAI has announced new community commitments for proposed data center projects, including a decision not to use non-disclosure agreements with public officials.

The change follows scrutiny of data center developers using NDAs to conceal discussions with local governments. It also comes after voters expressed opposition to data center expansion in this week’s midterm elections.

OpenAI said it will still permit “narrow protections” for legitimate security information, trade secrets, and proprietary or competitively sensitive information. The policy therefore represents a retreat from blanket secrecy rather than an end to all confidentiality measures in its discussions with communities.
